Article 161
Opposition Divisions
- An Opposition Division shall be responsible for taking decisions on an opposition to an
application to register an EU trade mark.
- The decisions of the Opposition Divisions shall be taken by three-member groups. At least
one member shall be legally qualified. Decisions relating to costs or to procedures shall be
taken by a single member.
The Commission shall adopt implementing acts specifying the exact types of decisions that
are to be taken by a single member. Those implementing acts shall be adopted in
accordance with the examination procedure referred to in Article 207(2).
